Convents Expiration Demand Action

On June 17, 2020 the Covenants for Phase 1 expire. On Dec. 3, 2020 the Covenants for the 1st addition to Unit 7, Phase 1 also expire. The other Covenants expire through 2021 until 2029 but a very few do not have expiration dates which actually may compound the problem.  At the end of this article you will find a CHART OF COVENANTS with expiration dates and the manner of amending or renewing. I hope this will better help you understand the expiration dates.

The expiration of the Covenants should be the number one concern of all residents. We have all heard questions such as, Does the POA “go away?”, Will I still have to pay dues?, Who will enforce the Covenants?, What happens to the amenities?, What will be the role of the City? and dozens more of valid questions. The amenities give great value to our community and I hope solutions can be realized to the upcoming expiation of the Covenants.

There is much work to be done on this problem and if we wait too long, solutions that may be possible now will not be possible as we get closer to the expiration dates or actually wait until some do expire.

In June 2016 we may be electing the last board under the bylaws as written today. Election of that board and the selection of capable and qualified people is critical. Not only do they have to be qualified but they should have a thorough understanding of the documents that govern our community.

Oursee-waste corporation ( the POA is a corporation) is governed by state statute, bylaws, Covenants, Agreements, Policy and Procedure and dozens of legal opinions. In past years a training session was conducted by Lloyd Ramirez and each new board member received a NOTEBOOK which contained copies of many of those documents. The board elected in 2016 should make it a goal to have such a training session. That board should also make it their number one goal to address the Covenant expiration and prepare accordingly. At this time in the history of Diamondhead I believe a smaller board with shorter terms is prudent. Contrary to some claims I do not believe anyone would want us to lose the amenities since they are a treasure and enhance our property value regardless of where you live in Diamondhead.

It is my recommendation that we vote YES (for) Proposition 3.

  1. Good article. Agree that since the city took over some major POA functions, a more streamlined, smaller board with shorter terms is best for all Diamondhead citizens. With the various governing bodies here it’ll be interesting to see what the future of Diamondhead holds.
