    THE COUNCIL LAST NIGHT, ALL OF THEM, STATED THAT THERE WAS “NO” MISTAKE IN ZONING AND THAT THEY RESENTED THE DEVELOPER COMING IN AND DEMANDING THE ZONING BE CHANGED BECAUSE A “MISTAKE” WAS MADE.

    WHAT IS THE REAL TRUTH?????

    Some on the Council seem to equate “Economic Development” with anything new or expanded that can be taxed and thus provide more money for the Council to spend.

    The Developer of the proposed 170-unit complex now has to apply to the City Planning & Zoning Commission for rezoning approval. (P&Z commissioners are appointed by the Council.) The rezoning process is detailed in the Zoning Ordinance (140+pages): http://www.diamondhead.ms.gov/Documents/zoning_ord_2012-019.pdf

    The P&Z Commission cannot “unreasonably” deny “uses” but must follow the Zoning Ordinance. THE COUNCIL CAN ACCEPT OR OVERRIDE P&Z RECOMMENDATIONS. Once the CITY sets a precedent for REZONING OF RESIDENTIAL PROPERTY, look out! Check out other formerly nice subdivisions where former residential property has “turned commercial” via REZONING. Once it starts, ……
