It seems that everyone must be on vacation or think that everything is just fine here in Diamondhead. There are many things that we should be discussing now that we have apparently decided to become Mississippi’s newest city. Why have we not heard of petitions to be signed to present to a judge for the incorporation of Diamondhead? As BSL and Waveland continue to rebuild, they are going to want us for our valuable tax base.

I have the same concerns as you about BSL and Waveland wanting to annex Diamondhead to increase their tax base. I lived in Diamondhead previously for eight years and moved away for ten years. We have been back for two years and I now think it will prove to be the worst mistake I have ever made to move back. After all these years I am still hearing the same arguments against incorporating from the same people who lived here when I previously lived here.
Since the storm I believe Diamondhead has changed for the worse. There is no control over violations. Cars and trucks with loud exhausts are racing on our roads all hours of the day and night with boom boxes blaring. I am hearing from more people about vandalism. No one seems to care about what is going on.
If we don’t incorporate and get some control over our community I fear it will only get worse. If I don’t see some movement in that direction in the very near future I will definately move. Some of my friends have already moved and more are considering it.August 2, 2006 at 7:30 pm #2197
Has anyone heard anything from our new POA President and Board? Did’nt think so.
Maybe the right person was not elected to be President of the POA. Just a thought.
The Editor of this web site was my choice for POA President. He has proved himself more than once to all of us. Without this web site we would be in the dark 24/7.
The “old guard” does not want to incorporate Diamondhead, and they never have. It’s all about control.
We better get a plan before we become BSL or Waveland, MS….

Thanks Summer! Good to see you and flexable are trying to get things going here. I agree wholeheartedly with “flexable”‘s comments. There is no enforcement of covenants and our property values (which had been going up after Katrina) will certainly begin falling. There is a home near mine that has at least 5 jeeps parked in the front, side, and rear of the home. I’m not sure if the owner has opened a used car lot or a car repair shop! There are several homes in my neighborhood that have not had their lawns mowed in months. Several of us in this neighborhood are working hard landscaping our homes (following Katrina’s wrath) and have spent a large amount of time and money to make the neighborhood look nice and it is very disturbing to see the ones that are deplorable and unkept. Also, traffic is becoming a major problem with excessive speeding on streets that are narrow and curve more than roads winding around the mountains! I fear that someone will be killed including children waiting for school buses, walking, or riding their bikes. It is not uncommon to see drivers passing other cars who are going the speed limit, and I believe that none of the streets in Diamondhead were designated as having passing zones. Another problem is the enormous amount of building going on in our neighborhoods and roads being blocked by the vehicles of the builder’s workers (because the lots are so small they can not park off the road). The contractor should have these workers park their cars/trucks in some area (non residential) and transport them to the work site. With the rainfall that we are finally receiving, some of the contractors are not preventing erosion and washing of dirt, debris, and trash from getting into the drainage system and ending up in our lawns. I have had to dig out the ditch in front of my home three times in the last 6 weeks because it has become filled with soil and debris washing from the homes being built in my neighborhood. I have had to put new grass sod in the ditch. I do not think that I should have to sell my home because the POA is not enforcing rules and regulations within Diamondhead. We need protection from those residents and non-residents who are ruining our beautiful community. As I have said previously, the only we way we can do this is by incorporation and elect officials who will be obligated by law to do those things necessary to provide a safe environment for the city and its citizens. I agree we have many problems since the storm. I am sure our employees are overwelmed in trying to address the violations. However I dont think incorporating Diamondhead is a fix all or a solution. I see the very same condition in Bay St. Louis, Waveland, Pass Christian, etc…etc. that you see in Diamondhead and these communities are already incorporated. Being a “city” is certainly not the magic pill some people believe it to be. There are many question yet to be answered. Will we have to pay a city tax on our property? Will we still have to pay the $60 a month POA fee in addition to the city tax? How will the Country Club, Tennis World, Swimming pools, etc. etc. be subsidized?
Will the city own and operate them? Will they be open to the general public? Compared to Bay St. Louis and Waveland our roads are much better maintained. Will the roadways be resurfaced and maintained as often as they presently are after they are turned into public roadways? Can we still restrict there use? Does Percell agree with incorporation or will we have to defend a law suit? How does incorporation affect our agreement with Percell? And what makes you think that elected paid officials will be any more receptive than non-paid elected officials. After (or if) an incorporation I am sure we will all be back on this site complaining about the same things we are complaing about now. It will be the same dog just different fleas. The point is that if we wait too long, Bay St. Louis will recover enough to annex us. Most Country Clubs in other cities are private, meaning that those who choose to join and use its facilities pay for them, not the tax payers. With the amount of assessed property within Diamondhead and much more coming in the next few years, a new city would not have to assess taxes and POA dues. The tax millage would not have to be a large amount and probably would work out to be not much more than we pay in POA dues now. It would be more fair to all residents because those who do not utilize the golf, swimming, and tennis courts would not be subsidizing others. There are several options available for those facilities mentioned above:
1. Sell them to a private, non-profit organization composed of those who would use them and pay dues for maintenance.
2. Offer to sell the Country Club and the two golf courses to the Casino that plans to build at our doorstep. With a little planning, we might could convince the casino owners to allow Diamondhead residents a lower green fee than their clientele.
3.Keep the facilities, but require that ONLY ThOSE WHO USE THEM pay for their maintenance.
I am sure that with enough people working on this and using ideas from the community, Diamondhead can accomplish this effort to incorporate and provide more for its residents WITH REASONABLE TAXES!August 19, 2006 at 6:29 pm #2201
Your comments and suggestions are very well thought out and make a lot of sense however we still face the problem with Percell. As I understand it we are contracted to maintain all facilities for another 14 years or so and if we failed to do so then everything reverts back to Percell ownership. This would include all streets, airport, tennis world, golf courses, country club, etc. etc. Are they on board with incorporation or will we face a lawsuit? With the new casino announced I wonder if a default in our agreement would not be in their interest. If so,they may be waiting in the wings. Don’t want to be negative but I do remain suspious of others agendes regarding incorporation. My mind is not made up one way or the other regarding becoming a city.Ijust have some questions I would like answered before I chose a side. I agree with you that it won’t be easy concerning Percell; however, I feel that they might be persuaded to give up their agreement sooner. Is it true that Percell has sold all of their remaining lots in Diamondhead?
I heard several people say that they have. If that is the case, then why would they care what happens to Diamondhead. I have also been told that the Percell corporation has never had to pay POA dues on the property they held. Is that true? Also, if a lawsuit has to be filed, I feel fairly sure that a good legal mind can prove that they have not lived up to the original agreement as they have never enforced some of the original covenants, and of late, very few. We need some answers from our “leaders” here that were elected in June. Just more thoughts on the subject….

It is my understanding that Percell has about 1,000 lots still available to sell although I have verified that as fact. It is commonly known that Percell does not pay the POA fees on these lots. It is also my understanding that Percell can vote on issues involving Diamondhead but can not vote for officers. This is sort of strange arrangement. It is rumored that Adams Homes also has been exempted from having to pay POA fees. Again, I have not comfirmed this but is is what is going on around Diamondhead. In reference to incorporation, it seems most folks are concerned that if we don’t incorporate we will be annexed by Bay St. Louis. Why is this a concern? Would this be bad for us? I do not favor Bay St. Louis or Waveland annexing us I just want to undertand the concerns better. I know some are dreaming of becoming mayor, councilperson, etc. etc. with a new city and that would be more difficult for them if we were incorporated by an exsisting enity. Could this be a reson for being opposed to it? I want to take a position on this issue and just want to be better educated on the pros and cons of incorporation. You can be sure that when incorperation occuers and saleries for politicians are made a reality there will be an unending line of pompus egoes awaiting due dillegance and servitude from their subjects on unenlighted decisions developed in the dark of night over private telephone lines. Heaven forbid discussion and voteing in an open meeting with published minutes. It will probably be a lot like it is now I would say. Lawsuits are probably already being designed in case of this, or in case of that, with attorneys fees already being compiled and special interest being served. Another more favorable sceinario could be, We have the best of people in positions who also have the courage and sense of fair dealing to under take this road it seems we are sitting out on. They of course will need all of our support and consideration to direct a favorable out come to incorperation and they will have much confusion to overcome due to past poor decisions. Lets just hope that the past does not repeat itself. We must insist upon openess and fairdealing and our community can be even be better in the future. I remember a couple of years ago there was a group that was getting all the information about incorporating Diamondhead, but they did not want to share this expensive info. They were afraid the BSL would use it to
annex Diamondhead. Oh! well…
I hope someone can tell me if it is possible to incorporate Diamondhead. Was there an agreement with Purcell that we could not do anything until 2025?
Do we still pay the POA dues? Fire Department? Will there be city taxes, if incorporated?
Is it true that we are going to have an open meeting, but we have to put our questions in writting? Oh! give me a break. I guess the POA Board can
choose the questions they want to ansewer.
If anyone can enlighten me with any info, please do.

Don’t know where everyone is but we should be taking advantage of this site to communicate events, ideas, etc. etc.. As far as the annexation is concerned I heard that the city of Bay St. Louis already has a plan to file for annexation of Diamondhead, but…….only part of Diamondhead. I am told that they only want to include the south side and the commerical area where the supermarket is located. This way they can benefit from the tax base of the casino and businesses without assuming the libility of providing services to the residence. If true, this would be smart on their part but determinal to the residence of Diamondhead. But then again, what else is new. I have not heard of these rumors, but it would not suprise me if BSL comes after us for the reasons you mentioned. $$$$
Do we have any leadership in Diamondhead? If we do, you can bet that they are asleep at the wheel. I for one have not seen any leadership since I moved here several years ago.
If our “leaders” do not protect us, it’s time for a recall. Are they cluless? If not, they need to let us know what is going on and what
can we expect in the near future. I for one do not like surprises.
How much hold does Purcell have on us? I for one am tired of paying for
amenities that stay in the red. Some group made a very bad deal with Purcell and we are paying for their mistakes.
If I ever post something that is not correct, please feel free to correct me.
